
Blueshift IP co-founder and software patent expert Robert Plotkin recently authored an article for Westlaw Today titled “How AI Is Affecting the Patent System.” The piece provides information on real-world applications of artificial intelligence and key challenges that AI raises for the patent system, particularly as AI has been used to automate the inventive process. For example, the USPTO recently requested public comment on a variety of questions related to AI inventorship and patentability. These questions included whether an invention created using assistance from an AI system could be patentable, whether AI inventorship raises any significant ownership issues, whether the USPTO should expand its guidance on inventorship to address AI, and whether any statutory challenges should be made in light of issues raised by AI contributions to inventions.
